You just have to make sure that you don't try to claim her if he's already done so. Remind him that he cannot claim her because she doesn't live with him and he doesn't have custody, it's fraudulent. He can be reported (esp. if he is not paying child support) b/c he doesn't have custody. Contact a lawyer to receive advice on this.
