    My husband and i have been seprated for almost 11 months and our daughter is 10 months we do not live together and i support our daughter he doesnt help . when taxes came around it was brought to my attention that he claimed our daughter on his taxes . i dont think thats right seeing she does not live with him . if you could get back to me thank you..

    Personally, if he filed and claimed her, HE will be in trouble. You just have to make sure that you don’t try to claim her if he’s already done so. Remind him that he cannot claim her because she doesn’t live with him and he doesn’t have custody, it’s fraudulent. He can be reported (esp. if he is not paying child support) b/c he doesn’t have custody. Contact a lawyer to receive advice on this. If you were providing for her, then you have the right to claim her.
